  • 1. FRAMEWORK/RECEPTORS

    The Website https://piranhasupplies.com , is a B2B (Business to Business) platform and is therefore intended exclusively for PROFESSIONAL CUSTOMERS, i.e. COMPANIES AND INDIVIDUAL ENTERPRISES, who use the goods purchased or services provided through this Piranha Supplies Shopping Portal/Online Shop (hereinafter referred to as the Portal/Online Shop) for purposes related to their commercial, industrial and professional activity.

    Consumer law and all related rules do not apply to these customers and the transactions carried out through the Purchasing Portal/Online Shop.


    Therefore, these GENERAL CONDITIONS OF SALE are intended exclusively for the aforementioned customers (PROFESSIONAL CUSTOMERS) and apply to any commercial transaction carried out through the Portal/Online Shop.

    If you are not a customer of this sector, you should not access the website, namely the Online Shop.

    Piranha Supplies reserves the right to require identification of the company or sole proprietor prior to using the Portal/Online Shop, and will not provide information on prices and commercial policies, as well as products and services to end consumers.

    Piranha Supplies will not process any orders placed by users who are end consumers or who do not comply with these general terms and conditions of sale.

    If advance payments are made for purchases made by final consumers or which violate these general conditions, Piranha Supplies will refund the amount, after deducting all administrative and financial costs resulting from the purchase and said refund, which are set at €2.0 (two euros).

    The creation of an account and/or the purchase of any good or service on this Portal/Online Shop determines full acceptance of these Terms and Conditions of the Piranha Supplies Shopping Portal.

The Piranha Supplies Shopping Portal/Online Shop is the property of PIRANHA GLOBAL, limited, with its registered office at Parque Industrial Coimbrões, Lote 71, 3500-618 Viseu, with the single registration number (Conservatória do Registo Comercial de Viseu) and legal person number 507 776 003, hereinafter referred to as PIRANHA GLOBAL.

    • 4. CONDITIONS OF USE OF THE PIRANHA SUPPLIES SHOPPING PORTAL/ONLINE STORE

      Users of the Portal/Online Shop may only be the legal representatives or persons who can act on behalf of the B2B Customer.

      Use of the Portal/Online Shop must strictly comply with these Terms and Conditions, as well as the applicable Portuguese legislation.

      The B2B Customer must, when using the Portal/Online Shop, provide the data necessary to carry out the acts selected by it (creating an account and/or placing orders or purchases), and will therefore be solely responsible for the content, veracity and accuracy of such data.

      The professional domicile or registered office of the B2B Customer will be that which they provide and which will be affixed to all invoices relating to commercial transactions carried out through the Portal/Online Shop.

      Any change of business address or registered office will only be enforceable against Piranha Supplies if it is duly informed by entering the new data in the B2B Customer's registration account on the site.

      Piranha Supplies expressly declines all responsibility for websites and links, as well as their content, which allow access to or redirect to the Purchasing Portal/Online Shop.

    • 5. CHANGES TO THE SITE AND THE TERMS AND CONDITIONS OF THE PIRANHA SUPPLIES SHOPPING PORTAL

      Piranha Supplies reserves the right to unilaterally, at any time and without prior notice, change, modify or terminate these Terms and Conditions, as well as the presentation, content, products, services, prices, commercial policies, offers and promotions of the Shopping Portal/Online Store, and also to close the site, and cannot be held responsible for this.

      All changes and updates will be duly identified on the Purchasing Portal/Online Shop.

      If the B2B Customer does not agree with any modification, update or alteration, they can always stop using the Purchasing Portal/Online Shop.

    • 6. INTELLECTUAL PROPERTY/COPYRIGHT

      This website and the Shopping Portal/Online Shop are the exclusive property of Piranha Supplies, as are all the rights to their content, brands, logos, designs, images, texts and web design, audio or video materials, and everything contained therein, which are protected by intellectual property, copyright and related rights and industrial property legislation.

      Therefore, the use, transfer, reproduction, copying, distribution, storage or dissemination, by any means, of logos, texts, videos, images, or content or products guaranteed by intellectual property, is completely prohibited.

      The B2B Customer is obliged to comply with all legal conditions relating to intellectual property, copyright and other related rights in relation to the products and services contained in the Shopping Portal/Online Shop, as well as complying with any contractual conditions relating to their use.

      Piranha Supplies accepts no liability for the improper use of products or services in relation to intellectual property and copyright.

    • 7. SITE CONTENT

      Piranha Supplies makes no warranties as to the accuracy and completeness of the information and content of the website and the Shopping Portal/Online Store.

      The website and the Shopping Portal/Online Store are provided on an "as is" basis, without warranty of any kind, either express or implied, that they will function uninterruptedly or error-free.

      Piranha Supplies accepts no liability whatsoever arising from programming errors, defects in the operation of the computer system or deformation of the message, including typing errors.


    • 8. ACCOUNT CREATION

      In order to access and make purchases on the Shopping Portal/Online Shop, the B2B Customer must have a valid email address and register and create an account by filling in the form available online.

      The B2B Customer is solely and exclusively responsible for entering and providing data when filling in the form and Piranha Supplies cannot be held liable at any time or in any way for any delays or failure to process orders resulting from errors or inadequacies in the data provided by the Customer.

    • 9. PRODUCTS

      a. Product information

      Piranha Supplies provides all the information on the specific features, details and characteristics of the products or services it sells, through its own technical descriptions or those shared by its suppliers, photographs and videos.

      The photographs, videos and images on the website and the Shopping Portal/Online Shop are merely illustrative, so the B2B Customer should access and check all the details, features and specifications of the products before making a purchase.

      The images of the products displayed on the site may show slight variations from reality, such as differences in color, texture or other details, due to the limitations of viewing on different devices and lighting conditions.

      The Shopping Portal/Online Store product catalog is independent of other online stores in terms of the prices and products displayed, as well as the quantities in stock.

      Product specifications and features may be unilaterally changed by Piranha Supplies without prior notice.

      b. Product availability
      The products listed on the Shopping Portal/Online Shop are, in principle, available, but may become unavailable in the event of a stock outage.

      In the event of a stock outage after an order has been placed and paid for, Piranha Supplies will immediately inform the B2B Customer of the total or partial cancellation of the order, who may choose to reschedule delivery when the product becomes available again, or return the amount paid, which must be done within 14 (fourteen) days of being informed of their choice.

      Piranha Supplies reserves the right not to accept orders or to cancel orders already confirmed for products that are no longer in stock.

      Piranha Supplies does not guarantee the availability of products in the period between ordering and payment.

    • 10. PRICES

      The prices of each product or service are indicated clearly and in euros on the Purchasing Portal/Online Shop.

      The prices indicated on the Purchasing Portal/Online Shop include VAT at the legal rate in force at the time of ordering and payment.

      The price of each product or service does not include shipping, transportation or delivery costs, postal charges or any other applicable charges.

      The place of delivery of the order may lead to a change in prices due to shipping, transportation or delivery costs.

      The prices and products available on the Shopping Portal/Online Shop, as well as promotional campaigns, are exclusively valid for purchases made through the Shopping Portal/Online Shop and may not coincide with the prices charged in physical stores.

      Prices on the Shopping Portal/Online Store are subject to change unilaterally and without prior notice.

      Piranha Supplies will not be held responsible in the event of a manual, computer, technical or any other error which results in any change to the price shown on the Shopping Portal/Online Shop. If such an error is detected, Piranha Supplies will cancel the order and inform the B2B Customer of the situation.

    • 11. ORDERS ON THE SHOPPING PORTAL/ONLINE STORE

      The B2B customer must make the purchase and confirm it. They will then receive an automatic email confirming the commercial transaction.

      Piranha Supplies accepts no responsibility if this email is not received due to computer, technical or other problems attributable to the Customer.

      The Customer must make a copy or printout of the email, or save the data relating to their order.

      Once the order has been confirmed, the B2B Customer must pay exclusively by one of the means provided for in these Terms and Conditions.

      Once payment has been received, an email will be sent confirming the conclusion of the commercial transaction and the expected delivery date.

      The order will only be processed once payment has been received by Piranha Supplies.

      Piranha Supplies reserves the right not to accept or refuse, in whole or in part, an order, even after receipt of the automatic confirmation email, in the following cases:

      • When payment is not made within 5 calendar days of acceptance of the order.
      • Failure to comply with these Terms and Conditions.
      • Order placed by a final consumer.
      • If the data and information provided by the B2B Customer is incorrect, unclear, has errors or is unnoticeable or false.
      • If the order is flagged by the site's security systems as being an incorrect, irregular order, or an order likely to be fraudulent.
      • When the order cannot be delivered to the address provided by the B2B Customer.
      • If it is found that there has been an error in the presentation of the price of the product.
      • Other reasons arising from applicable legislation.

      Under no circumstances can Piranha Supplies be held liable for the cancellation or non-acceptance of an order under the above terms.

      The B2B Customer may request cancellation of the order up until the moment before the order is sent. Once this has been done, it will no longer be possible to cancel all or part of the order.

      If the cancellation request is successful, the B2B Customer will be notified by email and the cancellation will be processed at no cost to the Customer.


    • 12. PAYMENT METHODS

      Piranha Supplies offers B2B customers the following payment methods:

      • Credit Card
      • MB WAY
      • Paypal
      • Bank Transfer
      • Multibanco
      • Cash on delivery.

      Payments should only be made by the means indicated above.

      If the B2B Customer chooses another means of payment, Piranha Supplies will not be held responsible for it, for its loss, or for any damage that may occur to the Customer or to third parties.

      The order invoice will be sent, upon receipt of payment by email, to the email address provided by the B2B Customer.

      If the Customer requires a physical invoice, they should contact Piranha Supplies by one of the means provided for in these Terms and Conditions.

    • 13. PAYMENT TERM

      Payment must be made as soon as the order is confirmed.

      If Piranha Supplies has not received payment within 5 days of confirming the order, it will cancel the order and cannot be held responsible for this.

    • 14. TRANSPORTATION

      Piranha Supplies will send orders by the means available for this purpose, or through the transport companies with which it has agreements.

      Products ordered through the Shopping Portal/Online Shop will only be dispatched and delivered on working days, so Saturdays, Sundays and public holidays will not be taken into account for the delivery time.

      Piranha Supplies does not guarantee delivery if the address given by the B2B Customer is incorrect, false or illegible.

      The B2B Customer, or a person designated by him, is obliged to check the products and their packaging at the time of delivery for damage.

      If damage is found, the order must not be accepted and must be returned in accordance with our returns policy. Piranha Supplies will reimburse the amount paid for the order and shipping, provided that the return process is duly completed.

      Piranha Supplies will not be held responsible for missing or damaged products when the delivery receipt for the products is signed by the B2B Customer or their designee upon receipt, or when it is not returned within 15 days.

      Delivery and acceptance of the order shall be deemed to have taken place when the delivery receipt is signed by the B2B Customer or their designee.

    • 15. SHIPPING COSTS / POSTAGE

      The cost of transportation, postage or shipping is always due.

      These costs will be added to the total price of the products selected.

      Before confirming your order, the B2B Customer will always be informed of the amount of these costs, as well as the total price of the order.

      Piranha Supplies reserves the right to change the prices of these costs unilaterally and at any time.

      Piranha Supplies also reserves the right to split the delivery of the order in the event that products that are part of the order are not available. In this case, we will notify the Customer of this situation by email.

    • 16. DELIVERY TIME

      The average delivery times for products available and in stock are as follows, from the moment payment is received:

      • Mainland Portugal and Spain - 3 working days.
      • Madeira and Azores - Between 10 and 20 working days.
      • European Union countries - 8 to 10 working days.
      • Countries outside the European Union - 10 to 12 working days.

      Piranha Supplies will never be liable or subject to any penalties for late delivery, which will always be justified by reasons of force majeure or other circumstances beyond its control.

    • 17. COMPLAINTS

      Any complaint, be it about the products, transportation (loss or lack of products/damage caused to the products by this), quality of the products and others, will only be analyzed and processed when it is formally submitted in writing, within 15 days of receipt of the order by the B2B Customer, to the following email global@piranha.com.pt.

    • 18. RESERVATION OF PROPERTY

      The products supplied to the B2B Customer will remain the property of Piranha Supplies until they are paid for in full, and the Customer will be responsible as trustee until the obligations assumed have been fulfilled in full.

      The risk of loss or deterioration of the products shall be borne by the Customer from the moment of receipt.

    • 19. WARRANTY

      All products sold on the Piranha Supplies Sales Portal/Online Store are guaranteed for 6 months from the date of delivery, under the terms of Article 921.2 of the Civil Code.

      Products are excluded from the guarantee if they fail or are damaged as a result of insufficient or deficient maintenance, improper use, failure to comply with power supply recommendations, defective storage conditions or extreme use.

      The guarantee is also excluded in the following cases:

      • Physical damage (broken/damaged/corroded/jammed equipment, etc.)
      • Misuse, damage caused by falls, negligence, fire, water, electrical or atmospheric disturbances, etc.
      • Damage caused by transportation carried out by the Customer or third parties on their behalf;
      • Use of options or consumables not suitable for the equipment in question;
      • During this period the equipment has undergone technical intervention, with labor and parts outside the services of Piranha Supplies.
      • Alterations to the original product (e.g. removal of the serial number sticker).

      In order to enforce the warranty, it is essential to show the invoice or purchase receipt and the rules set out in articles 913 to 922 of the Portuguese Civil Code apply.

    • 20. RETURNS

    • 21. PROMOTIONS

      Promotional offers or commercial campaigns published on the Portal/Online Shop are valid only for the time at which they are displayed and in accordance with the conditions established.

      In the case of returning or exchanging products purchased under commercial campaigns or Promotions, you will only be credited or given the amount you actually spent on the purchase of the product you wish to return or exchange.

    • 22. LIABILITY

      Piranha Supplies shall not be liable for any loss or damage suffered by the B2B Customer or third parties arising from any viruses and computer attacks, network or internet supply problems, interception or manipulation of electronic communications by third parties, phishing, installation of malware, Ransoware and social engineering.

    • 23. PERSONAL DATA

      All works, illustrations, works and images reproduced or represented on the piranhasupplies.com website are strictly reserved under the terms of copyright as well as intellectual property rights, for the whole world. Accordingly, and under the terms of the Intellectual Property Code, only the use of information for professional purposes is authorized, subject to contrary provisions including more restrictive provisions contained in said code.

      Any total or partial reproduction or representation of the piranhasupplies.com website, in whole or in part, of the elements included therein is strictly prohibited.

      The company names, trademarks and distinctive signs reproduced on the piranhasupplies.com website are protected under the terms of the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the owner of the PIRANHA® trademark.

      If the User wishes to use information or materials from the site, he/she must obtain prior written authorization from PIRANHA® (PIRANHA GLOBAL).

    • 24. APPLICABLE LEGISLATION

      These terms and conditions and all commercial relations carried out through the Portal/Online Shop are governed by Portuguese law.
